Should the will of the people override the constitution?
It really depends on which state, in Texas we can override it to the point of dissolving it writing a completely new one if the people of Texas want to. I don't know about California though, but I would not doubt that they can over rule it if it is their will.

Calling all lawyers - what is murder?
By reading the story, it seems to me that the cause of death may have been when the victim hit his head on the concrete when he fell. Generally speaking, two punches isn't enough to kill someone. I agree in that this should not be a case of simple battery, but I can see where the defense lawyer would argue involuntary manslaughter.

Should somebody get the death penalty for starting forest fires?
Things are dry a lot of the time here, and water supplies aren't always reliable. Arson is one of the most heinous crimes in this state.
