XP and DX9 seem fine.
The answer is play it in Dx10.
With a Vista or Win 7 playing the game in DX9 can crash the game due to the realtek.

This question asks how to delete a locked file in Windows XP. The answers in there don't apply to Windows Vista 64. Is there some app like Unlocker that works in Vista 64?

You can use Process Explorer be deleted without actually closing the application....
I use Emco UnLock IT on my vista 64.

My first instinct would this issue resolved.
Windows 7 is coming out have the reduced functionality option to get your stuff out of Vista.
I wouldn't bother worrying with activating Windows Vista at this point.
