I would also check....
Could be something in the air injection in the right wrist .
Should not change much if at all during accel/decel conditions.

Ok i kind forgot about this problem during the winter but during summer time when i would accelerate with the Ac on there would be a faint wining noise and If i cut off the ac off and accelerate the noise stopped. So i know it has to be Ac related so ...

Your problems are either of the two the Fan Noise this is more of a "Somethings Going" type Noise..
Or your AC belt might be damaged...

I think noise in 4th....
I never though too much...and although it will make the noise in any gear at 43 mph, it is most pronounced while in 4th.
Care of this in the e46 m3? I think i have the same whirling noise.
